TERMS & CONDITIONS
Participation in ‘A Moment With Your Kakiis’ challenge (“the Contest”) constitutes the entrant's (or entrant’s parents / legal guardians, if the entrant is a minor) full and unconditional agreement to and acceptance of these Terms & Conditions (including any variation to the same made by Community Shapers Sdn Bhd without any requirement of notice) and the decisions of Community Shapers Sdn Bhd which are final and binding.
ELIGIBILITY
The Contest is open to Malaysian citizens & Non-Malaysian Citizens residing in Malaysia for more than six (6) months.
Employees of Community Shapers Sdn Bhd, their immediate families, affiliates, subsidiaries, advertising/promotional agencies, other related agencies and suppliers are not eligible to participate.
CONTEST DURATION
The Contest duration is from 10th November 2008 to 5th December 2008.
Results will be available on http://www.kakiis.com/contest by 10th December 2008. Winners will be contacted by Nuffnang and prize giving will be carried out on 13th December 2008.
HOW TO PARTICIPATE
Access the Contest website via Kakiis.com/Contest.
1. Sign up and be a Kakiis member.
2. Record a video themed ‘A Moment With Your Kakiis’ and upload it onto Kakiis.
3. Share the video with your friends via the “Share This Video” function and get them to vote for your video.
4. Upon receiving your video, moderators will go through the video content to ascertain that i) it is safe for public viewing and does not contain any offensive content; ii) it involves a moment with your kakiis.
5. If the video fulfills both these conditions, moderators will then link it up to Kakiis.com/Contest. At this stage, the video is considered valid as a contest entry.
6. Members of the public can vote for their favourite videos through the online voting mechanism.

WINNER SELECTION
1. For the Contest, there will be ONE (1) Grand Prize winner.
2. Popular votes (votes cast by members of the public for their favourite videos) make up 50% of the score calculation. The remaining 50% will be evaluated by Kakiis judges.
3. Kakiis judging criteria are as below:
1 – Creativity (20 Points)
2 – Relevance Of Content (15 Points)
3 – Effort (15 Points)
4. Each criteria will be accorded points based on the above, adding up to 50 points.
5. For calculation of the popular vote which compromises 50% of the total score, the top 10 videos with the highest votes will garner 50 points, the subsequent 10 videos with the next highest votes will get 40 points and the subsequent 10 videos with the next highest votes will get 30 points. All other videos with the 31st – 50th highest number of votes will get 20 points and anything after the 50th Highest will get 10 points.
6. The winner will be selected based on the entry with the highest points (out of a total of 100 points). In the event of a tie, the winning entry will be determined by its creativity which shall be judged by Community Shapers Sdn Bhd at its absolute discretion, whose decisions are final and binding. Appeals to check the status of entries will not be entertained.
7. The winner will be notified on the event night on the 13th of December 2008 (location will be notified – please log onto kakiis.com/contest for updated information). Community Shapers Sdn Bhd is not responsible for and shall not be liable for any late, lost, or misdirected notification, or for the winners’ unsuccessful efforts to accept or claim any Prize.
8. Winners (or winners' parent/legal guardian if winner is a minor) will be required to sign and return a release of liability, declaration of eligibility, and where lawful, a publicity consent agreement from Community Shapers Sdn Bhd. By entering, each entrant (or entrant's parent/legal guardian if entrant is a minor) agrees to grant the Community Shapers Sdn Bhd and their respective parent companies, subsidiaries, affiliates, licensees, directors, officers, agents, independent contractors and advertising/promotion agencies the use of his/her name, details submitted through the Contest website, likeness, biographical data and statements for any purposes, including, without limitation, advertising, trade, or promotion, in perpetuity and throughout the universe, in any and all media now known or hereafter devised, without further compensation, unless prohibited by law. If a selected winner cannot be contacted, the registration is ineligible, fails to claim a Prize, or fails to timely return the completed and executed declaration and releases as required, the Prize may be forfeited and an alternate winner may be selected. Refusal or return of the winner’s notification as undelivered will also result in disqualification and an alternate winner may be selected.

Community Shapers Sdn Bhd reserves the right to substitute the Prize with another at any time without prior notice. The Prize is non-refundable and non-exchangeable for any other prizes.
GENERAL TERMS AND CONDITIONS
1. Community Shapers Sdn Bhd reserves the right to reject entries that are incorrect, incomplete or rude. Entrants agree not to knowingly damage or cause interruption to the Contest and/or prevent others from entering Contest.
2. Community Shapers Sdn Bhd reserves the right to change, amend and/or withdraw the Contest without prior notice. In the event that Community Shapers Sdn Bhd suspend or cancel the Contest due to any reason whatsoever, Community Shapers Sdn Bhd may select a winner in a random drawing from among all entries received for the Contest prior to the suspension or cancellation.
3. In case of any dispute, Community Shapers Sdn Bhd reserves the right to make the final decision and no further correspondence or appeal will be entertained.
4. Proof of submission of entry is not proof of receipt. Community Shapers Sdn Bhd and its respective parent companies, affiliates, subsidiaries, licensees, directors, officers, agents, independent contractors, advertising, promotion, and fulfillment agencies, and legal advisors are not responsible for and shall not be liable for: (i) telephone, electronic, hardware or software program, network, Internet, server or computer malfunctions, failures, interruptions, miscommunications or difficulties of any kind, whether human, mechanical or electrical, including, without limitation, the incorrect or inaccurate capture of entry information online; (ii); late, lost, delayed, misdirected, incomplete, illegible or unintelligible e-mails; (iii) failed, incomplete, lost, garbled, jumbled, interrupted, unavailable or delayed computer transmissions; (iv) any condition caused by events beyond the control of Community Shapers Sdn Bhd that may cause the Contest to be disrupted or corrupted; (v) any injuries, losses, or damages of any kind arising in connection with or as a result of the Prize, or acceptance, possession, or use of the Prize, or from participation in the Contest; or (vi) any printing or typographical errors in any materials associated with the Contest.
5. By participating in the Contest each entrant (or entrant's parent/legal guardian if entrant is a minor) agrees to release and hold Community Shapers Sdn Bhd, and its employees, officers, directors, shareholders, agents, representatives, parent companies, affiliates, subsidiaries, licensees, advertising, promotion, and fulfillment agencies, and legal advisors, harmless from any and all losses, damages, rights, claims and actions of any kind in connection with the Contest or resulting from acceptance, possession, use or misuse of any Prize, or travel to or from any Prize-related activity, including without limitation, personal injury, death, and property damage, and claims based on publicity rights, defamation, or invasion of privacy.
6. Community Shapers Sdn Bhd, and its respective parent companies, subsidiaries, affiliates, licensees, directors, officers, employees, agents, independent contractors and advertising/promotion agencies make no warranties, express or implied, in fact or in law, relative to the use or enjoyment of any of the Prize, including, without limitation, their quality, merchantability or fitness for a particular purpose.
